Prosecution Confirms Decision Not to Appeal Former President Yoon’s Release

Seoul: The prosecution announced on Thursday that there is "no change" in its decision not to appeal the release of impeached President Yoon Suk Yeol from jail. This confirmation by the Supreme Prosecutors Office (SPO) follows a statement by Chun Dae-yup, chief of the National Court Administration, who expressed the necessity of seeking a higher court's judgment through an immediate appeal.

According to Yonhap News Agency, the SPO emphasized that the decision whether to appeal a court's ruling to cancel an arrest is a matter within the prosecution's jurisdiction. The SPO noted that the prosecutor general made a quasi-judicial decision after thorough consideration and consultation with the investigation team and SPO leaders, and it should not be influenced by external pressures.

The prosecution has faced significant scrutiny after releasing Yoon from detention on Saturday. The release followed a court ruling that questioned the legality of the investigation and the timing of the prosecution's indictment, which rendered Yoon's detention invalid.

By law, the prosecution has until Friday to file an immediate appeal against the court's decision. The SPO stated that they are reviewing the calculation method of the detention period and the immediate appeal system for arrest cancellations. They plan to work with relevant institutions to reform these rules to eliminate any controversy regarding legal interpretations and potential unconstitutionality.
